Questions relating to the important changes proposed to the Annual Management Charge

As our lodge will be on the dividing line between top & bottom there may we’ll be issues that I need to think about. In the meantime can you let me know if my dog run is included & also what service level is proposed for grass cutting there & also in space between us & Pheasant Rock where trees were cut down(apart from few feet along track this area was left wild this year).
A - LTHLP MANAGEMENT
In terms of grounds maintenance to that area it is not intended that any thing changes i.e. The track heading north from Johns lodge along riverside continues to be cut, the dog run will be strimmed, the area between his lodge and Pheasant Rock was never intended to be manicured ( which I recall explaining to John when the trees were cut down) and as other bank areas is cut 2- 3 times a year and weed killed which I believe it has been this year , the grass along the roadside leading to Johns lodge is cut when all other grass is cut.

You say a final WSOS is still to be produced, does that mean that LTHLP Management have told you that they are prepared to revise the one they put out? If so in what way?
Am I right in thinking that it is proposed that the AMC (and so SLA etc) only covers the lower part of the site that is shaded, but the infrastructure figures quoted are for the whole site, with proposed split as noted covering the whole site?
Am I right in thinking that the proposed staffing fixed costs for half a general manager, full receptionist and 2 gardeners along with a share of warden services is purely for the lower end of the site as shaded in the site map?
Will LTHLP accounts distinguish between work done in the shaded area of the site and work done elsewhere?
My reason for asking is that the Property Factor Code of Conduct and requirements for the WSOS include the requirement for the property factor to meet the overriding objectives in relation to Financial Obligations eg “clarity and transparency in all accounting procedures and ability to make a clear distinction between homeowner funds and a property factor’s funds”.
It may be that this will be covered by the revised WSOS or Management Agreement – can you clarify?

1. I included the wording relating to the WSOS as I have not had a reply to our questions and as you have not had a reply to yours I assumed it wasn't finalised. Rupert was given a copy of the document before it went out and he made no comment on that section.
2. The proposed AMC charges as set out in Appendix F are those that will apply to the lower part of the site that is shaded (including also The Crannog, which was omitted in error). The infrastructure figures set out in Appendix E apply to the whole site.
3. The proposed staffing set out in Appendix C applies to the lower half of the Park as set out in the map (Appendix A)
4. The LTHLP accounts will be produced as they are currently and will include all the costs, however as we are proposing a fixed cost for the majority of the costs we will only be interested in the variable costs and it will only be those that we will check. However the accounts will be produced and we can add something into the new Management Agreement to make sure that we have access to them should we require it.

What is the Owners Association and what does it aim to do?
The LTHLP Owners Association was set up to:
*be a body to represent and secure the best interests of the owners
*to provide a singular line of communication between the Owners and LTHLP Management for all communal issues relating to lodge ownership for the benefit of the members
*to ensure that the responsibilities and obligations of LTHLP Management, as laid out in the Management Agreement and Regulations, are fully met
* to seek to improve and maintain the Park and its environment and to monitor and regulate any future developments planned or implemented on the Park
*to ensure that the apportionment of cost in the AMC calculation is justified and correct
*to provide a forum for Owners to meet on a regular basis
*to engage with LTHLP Management to preserve the aesthetic and environmental standards of the Park and to ensure that the activities on the Park and the policies adopted by LTHLP Management for attracting visitors to the Park are consistent with maintaining a high quality holiday experience for Owners and visitors in a quiet, rural environment and in line with Clause 9 'Amenity of Development' of the Regulations
*any other aims as may be agreed by Owners at a General Meeting of the Assocation.

The Park Manager, Jo Barrie, is responsible for all areas relating to suggestions or complaints. She can be contacted by telephone on 01567820323 or email her on owners@lochtay-vacations.co.uk. There is a suggestion log that has been set up to record any comments made by owners and LTHLP Management maintain the log to ensure than any issues are recorded and monitored.
